Assignment Task:

Learning outcomes assessed: students will be assessed on their demonstrated ability to: 

1. Analyse the impact of family domestic violence on families and children and advise appropriate measures to ensure the safety of family members. 

2. Apply the Family Law Act and other relevant legislation and principles to advise and assist clients with post separation problems. 

3. Reflect on the development of their competence as a family law professional.

Write a 2,000 word response according to the instructions below for Parts A & B: 

A. There is an Interim Parenting Application before the Federal Circuit Court of Australia at Parramatta. You act for the Applicant Respondent Father. You are to prepare a Case Outline Document for your client’s case which is to be handed to the Judge prior to the hearing. In your Case Outline Document, you should: 

1. Identify the issues in dispute. 

2. Identify and apply the following in your Summary of Argument, where appropriate: 

a. Relevant and current provisions in the Family Law Act (Cth) and the Federal Circuit Court Rules that apply; 

b. Relevant and recent cases concerning children where violence is involved (so you will need to research: see below); 

c. Relevant social science literature, reports or guidelines about parenting, family violence that reinforce the submissions for your clients’ application (so you will need to research: see below). 

3. Formulate the Interim Parenting Orders you are seeking, consistent with your submissions and also consistent with the Father’s Affidavit. The Orders should be brief and should note take up significant word count, e.g.: 

a. Sole parental responsibility to the mother. 

b. The children Live with the mother. 

c. The children spend time with the father each Saturday from 9.00am to 5.00pm to be supervised by a contact service. 

4. Footnote all sources you use in preparing your Case Outline Document. DO NOT use the footnotes for submissions. Simply state the case, legislation or social science research you rely on and a brief explanation as to the relevance. E.g.

B. Reflect on the challenges of this assessment task and how it contributed to the development of your competence as a family law professional (allow for about 200 words for Part B) 

For this assessment, students will be required to show that they understand:

? the social science literature, reports, and guidelines that might inform the outcome of children’s matters/parenting arrangements concerning family violence;
