Introduction 

This is a case study of Tom who is a 55 years old man with advanced lung cancer and multiple metastases. Tom has been returned back to the hospital for the end of life (EOL) care as his condition was deteriorating. While taking care of Tom and managing his pain, some issues have been identified. It is discussed below how the legal and clinical issues in the hospital settings can affect to make clinical decisions and why it is important to consider a shared decision making in that situation.

Identify issues

During the palliative care treatment of Tom, the legal issue that has been identified was the claim made by Tom’s daughter Carina. For the pain management, Tom was being given morphine/midazolam through the syringe driver after he consented. Tom’s daughter Carina, however, was against morphine and wanted to stop morphine treatment. Carina told that she has the power of attorney, wanted to do everything to save his father and she has the capacity to make decisions for her father. Power of Attorney is an instrument whereby a principal authorizes an agent/a person, to perform acts, most typically financial transaction on behalf of the principal. Nevertheless, it does not give that agent the right to make decisions regarding the principal’s lifestyle, medical treatment or welfare .  On the other side, Tom confirmed that his mother Cec was Tom’s enduring guardian and Tom has done advanced care paper. Enduring guardianship covers the lifestyle decisions and health care decisions when the principal loses the capacity to make his/her own personal or lifestyle decisions . Additionally, the written note done by medical registrar was also found which mentioned NFR, not for CPR, not for ICU admission and was signed and dated by Tom.
