Rafiq and Saara had been married for six-year. Two years ago, Rafiq was attacked in the street by a gang and suffered severe injuries. Since the attack, he suffered from a post-traumatic stress disorder and was prone to suffering flashbacks and rage about the incident.

One evening she told Rafiq that she was going to move back in with her parents, take the children and apply for divorce. Rafiq was absolutely distraught when he heard this. He went to the garden shed and started to sob uncontrollably. He punched the walls in a rage, then looked down and noticed some weed killer. Thinking that if his wife was really ill, she would not be able to leave and take he children, he walked back into the house, appearing calm. During the evening, he dropped some of the weed killer into Saara’s drink. She drank the mixture and died.
Rafiq is charged with murdering Saara. He claims that he did not want to kill Saara, he just wanted o make her too ill to leave him. Se also claims that due to his condition of PTSD, he was acting in a “red mist of rage” and had no control over his actions. He further claims that he “lost it” when Saara said that she was leaving him and wanted a divorce.
Discuss Rafiq’s liability for murder and any defences that may apply.
3. After a cup final match between Wolverton Rangers and Brom Albion, fans from both sides headed to a crowded pub near to the Rangers ground.
On the way into the pub, caught up in the crush of fans trying to get to the bar, Bob trod on Calvin’s foot and apologized.
Calvin, a Rangers fan, threatened Bob, an Albion fan, by saying “Get out of my way or I will smash your ugly face in.” Bob, ion hearing this, was not in the least bit frightened, but he pushed his hand into Calvin’s face and pushed him backwards, Calvin stumbled as he was knocked off balance by the push and he fell into a carved wooden panel, causing a large area bruising to his back.
Later on, Calvin had consumed a few pints of beer and smashed it on the bar so that he was holding a jagged piece of smashed glass. Calvin hurled this as hard as he could at Bob, who ducked out of the way. The smashed glass flew over Bob’s head and became embedded ino the eye of John, a fellow Rangers fan who was sitting quietly trying to enjoy a post-match drink. John was blinded in his eye as a result of the injury.
