Mr. Vishwajeet, your client agrees to sell to “Power-driven Motors Co.”, a specific cargo of goods supposed to be on its way from England to Bombay. It turns out that, before the day of the bargain, the ship conveying the cargo had been cast away and the goods lost. Neither party was aware of these facts. Now “Power-driven Motors Co.” has filed a suit against your Client, Mr. Vishwajeet. Advice Vishwajeet with legal circumstances with regard to the current status and nature of the agreement between the parties.
Suraj was the servant of one ‘Symbiosis Law Firms’ in Pune. They had come to Satara, a village in Maharashtra to purchase a remote property for the expansion of their law firm. The property was located outside the village and therefore the locals believed it was haunted. Suraj was curios and wanted to see the “ghosts”. At night, as he and his friends were making their way to the property, they saw a flickering light within the premises which, due to the strong wind, seemed to move. They thought it was an illusion of a ghost. Suraj jumped into action as he unleashed his small knife to attack
the “ghosts”. Turns out, they were local indigenous men with a kerosene lamp who had gathered under a tree to collect some flowers. Suraj’s indiscriminate hacking caused the death of one man and injured the two others. Suraj has come to you now saying that he has murdered someone and he needs to be saved.
As an advocate to Suraj, are you willing to take this matter. If No, please explain the circumstances as to why and if Yes, Advice Suraj what is to be done.
Mr. Sumeet, the owner of a boat, contracts with Ms. Aditi to take a cargo of jute to Mirzapur, for sale at that place, starting on a specified day. The boat, owing to some avoidable cause, does not start at the time appointed, whereby the arrival of the cargo at Mirzapur is delayed beyond the time when it would have arrived if the boat had sailed according to the contract. After that date, and before the arrival of the cargo, the price of jute falls. Is compensation payable to Ms. Aditi by Mr. Sumeet? As an advocate Advice Ms. Aditi.
