KIZITO WAZITO is charged with the following offences:
Statement of the Offences: Genocide, Crimes against Humanity, War Crimes contrary to Articles 6, 7 and 8 of the Rome Statute, 1998.
 

Particulars of the Offences
In 2020, during a state of internal and/or international armed conflict existed in the territory of THE STATE OF AMACHINA, KIZITO WAZITO planned, instigated, ordered, committed, and aided and abetted the offences charged. It is further alleged that he participated in a joint criminal enterprise to commit these offences.
IN THE ALTERNATIVE, that he is criminally responsible under the superior responsibility doctrine since the offences were committed by his subordinates over whom he had effective control.

FACTS
In February 2020, a referendum was held in THE STATE OF AMACHINA to decide on the independence of a part of THE STATE OF AMACHINA, the province of Natura. The result of the referendum was against independence. The Government of THE STATE OF AMACHINA favoured retaining a unified country. The majority of the people of THE STATE OF AMACHINA were from the AMACHINA ethnic group. In the province of Natura, the Natura Wetu National Party (NWNP) vigorously campaigned for an independent Natura Province. They preferred secession from THE STATE OF AMACHINA. In Natura Province, the majority of the citizens hailed from the Natura ethnic group, while the minority were from the Amachina ethnic group. The NWNP was supported by a large part of the Natura ethnic group. The leader of the NWNP was the accused, KIZITO WAZITO. The NWNP received backing from the neighbouring country of KAYAYE which had historically strong relations with the NWNP. The majority of the people living in Natura Province were of the same ethnic group as the population of the neighbouring State KAYAYE, namely, the Natura ethnic group.
