The last thing you want to happen is for your client to be shown to be a ‘liar’ in court, so you must determine if the scenario the client presents could possibly be true. Could he be telling the truth? How? How will you explain to the court the difference between what your client claims is true and what the prosecution is likely to portray as the truth? Show your calculations for the BAC based on the information provided by your client. Even if the BAC is above the legal limit – indicate how the discrepancy between the calculations and the results could have occurred. [10pts]
