Consider the reasons as to why Victoria has not adopted the model/ uniform laws in relation to Work, Health and Safety. Discuss your opinion as to whether the existing Victorian OHS laws are fit for purpose? 

Notes on the question 

This question refers to Victoria’s decision not to adopt the harmonised WHS legislation and whether it was wise, or not and whether the legislation is ‘fit for purpose’. I would argue that the decision was driven by political factors (different parties in power at state and federal level – WA didn’t change either). Your job is to decide whether that is a good thing, or not. I have not seen much published academic material on this (let me know if you find some), but there are consultant reports and submissions from the various organisations with an interest, e.g. employer associations and trade unions. Those in Victoria always seem to take a different position than those who live elsewhere in Australia so this can be a good one for a response post
